Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of The Surf Shop at thesurfshop.ai (the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service is currently in beta and is provided on an “as is” and “as available” basis. Features may change, break, or be removed, and the Service may experience downtime. We make no warranties about the Service during the beta.

2. What the Service is

The Surf Shop is an AI shopping assistant that recommends surf apparel and gear from independent surf brands. It helps you discover products and save them to a “stash,” but it is a recommender, not a store.

The Surf Shop is not the seller or merchant of record. When you choose to buy something, we hand you off to the brand’s own website to complete checkout. Orders, payment for products, fulfillment, shipping, returns, and refunds are the responsibility of the brand you buy from, and that brand’s own terms and policies apply to your purchase. We do not process product payments and do not ship orders.

3. Your account

You are responsible for keeping your account credentials secure and for all activity that happens under your account. Please let us know right away if you believe your account has been accessed without your permission.

4. Pro subscription

The Surf Shop offers an optional Pro subscription, billed through Stripe:

• Monthly: $9.99 per month, with a 7-day free trial.
• Annual: $99.99 per year (no free trial).

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time through the in-app billing portal; cancellation stops the next renewal and your Pro access continues until the end of the period you have already paid for. During the beta, payments are non-refundable for partial billing periods. Prices and plan details may change as the Service leaves beta; we will tell you before any change affects you.

5. Acceptable use

When using the Service, you agree not to:

• use the Service for any illegal or harmful purpose;
• abuse, overload, disrupt, or attempt to gain unauthorized access to the Service or its systems;
• scrape, harvest, or systematically extract data from the Service; or
• reverse engineer, decompile, or attempt to derive the source code of the Service, except where the law expressly permits it.

6. Intellectual property

The Surf Shop name, the Duke and Lani personas, our software, and the look and feel of the Service belong to us and are protected by intellectual-property laws. You may not copy or reuse them without our permission.

Product names, images, descriptions, trademarks, and other content belonging to the surf brands remain the property of those brands. We surface that content to help you shop; it is not ours and we claim no ownership over it.

7. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations, product information, prices, or availability shown will be accurate or current. Always confirm details on the brand’s own site before you buy.

8. Limitation of liability

To the fullest extent permitted by law, The Surf Shop and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. This includes anything related to a purchase you make on a brand’s site after we hand you off. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50.

9. Changes and termination

We may update these Terms as the product evolves. When we make material changes, we will update the effective date above and, where appropriate, notify you in the app. Your continued use of the Service after a change means you accept the updated Terms.

We may suspend or terminate access to the Service, for example, if these Terms are violated or if we discontinue the beta. You may stop using the Service and delete your account at any time.

10. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules.
